The answer is suicide

EXPLANATION:.
A man (or a woman) tries to commit suicide.
If the attempt fails, the man will be alive and accordingly,  he will be punished in accordance with the legal provisions.
If the attempt succeeds, the man will be dead, and it is NOT possible to punish a dead man.
